NOTICE TO MEMBERS

Do not sign this Membership Agreement before you have read both sides, because terms on each side are a part of this Agreement. Member is entitled to a completely filled in copy of this Agreement upon request. Member acknowledges that they have been told: (A) That this document is an Agreement and will become legally binding upon its acceptance by STRIKING BEAUTIES; (B) The terms and conditions of this Agreement; (C) That they acknowledge that they have examined the facilities and that they accept them
in the present condition, and the Member voluntarily assumes any and all risk involved in the use of the facility and equipment and releases the club from all claims and liabilities; (D) There are no warranties either expressed or implied which extend beyond this Agreement. This is the entire Agreement, there are no other guarantees unless attached. The undersigned member has read, understands, and agrees to be bound by the attached Rules and Regulations as part of this Agreement. The rules and regulations
may be changed at anytime by STRIKING BEAUTIES, at its sole discretion. If any part of this Agreement is held invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect. Buyer’s Right to Cancel: If you wish to cancel this agreement, you may cancel by mailing a written notice by certified or registered mail. The notice must say that you do not wish
to be bound by this agreement (or words of similar effect). The notice must be delivered or mailed before midnight of the third business day after you sign this agreement to: STRIKING BEAUTIES, 18 CHURCH STREET, N.ATTLEBORO, MA 02760. Following cancellation, you may be asked to return all agreements, membership cards and other documents of evidence of membership. Any Member who is under the age of 18, must have a parent or legal guardian co-sign and guarantee this Agreement.
The Co-signer, along with the Member, agree to be bound by all the terms and conditions of the Agreement.

PAYMENT

I understand that I am in full control of my payment, and if at any time I decide to make any changes or discontinue the EFT service, I will call or write STRIKING BEAUTIES. Change of payment method will not affect other provisions and terms of my Agreement. STRIKING BEAUTIES assumes that all credit card numbers will be renewed with new expiration dates unless notified. Any billing change requires 30-day notice to STRIKING BEAUTIES, 18 CHURCH STREET, N.ATTLEBORO,MA 02760.

CREDIT CARD PAYMENT METHODS WILL INCUR A SMALL CARD PROCESSING FEE OF 3.4% 

IMPORTANT POLICIES CONCERNING YOUR MEMBERSHIP

1. Release and Waiver of Liability
   I, for myself, my heirs, executors and assigns, have read and understand this waiver and have been fully informed of and acknowledge, assume and accept the risks inherent in the use of the Club services and facilities. I voluntarily assume the risk of injury, accident, death, loss, cost or damage to my person or property which might arise from my use of the Club and I release the Club from any and all claims and liabilities resulting from the ordinary negligence of the Club and its owners, officers, employees or agents. I certify that I am in good physical health and am able to undertake and engage in the range of physical activities in which I choose to participate. I assume all responsibility for updating the Club of changes in physical and mental condition and for reporting all injuries sustained at the Club to the manager on duty at the time. *(Please note that a parent or guardian must sign on behalf of the minor).
2. Use of Center Facilities
   My membership plan type determines which facilities I am entitled to use at the Club. Club management may from time to time change the rules governing the operations of the Club, schedules of activities and hours open. Members shall be provided with notice of these changes. Unauthorized use of facilities may result in membership suspension or cancellation. Club management may suspend or cancel the rights, privileges or memberships of any Member whose actions are detrimental to
   the enjoyment of the Club facilities by other Members, or for failure to comply with Club rules.
3. Equipment and Services
   The Club is equipped with exercise machines, free weights, cardiovascular training equipment and various amenities. Certain services may require additional charges such as towels, childcare, guest fees, parties, personal training, etc. Management reserves the right to make reasonable changes in equipment, facilities and services. I agree to wipe down, and use with care, all equipment. I will report any damage to equipment immediately to management.
4. Annual and Administrative Fees for Changes, Transfers, Early Cancellations
   If I elect to change or transfer a membership agreement, it is not considered a new membership agreement, the liability waiver will apply, and the first paragraph of Buyer’s Right to Cancel will not apply. Members may cancel their membership obligation at any time by giving 30 day written notice. 
5. Membership Freezes
   If EFT or Paid in Full membership, member may freeze his/her membership once for a period of up to three months in a one year period for a TEN dollar ($10) monthly fee for each month frozen. Medical or military freezes may exceed three months with appropriate documentation. Maximum is one year. Student memberships may not be frozen.
6. 24/7 Usage
   I further acknowledge and agree to use said Studio at my own risk. I assume all risk of injury, damage or loss and shall hold said Striking Beauties,Studio and Landlord harmless from and indemnify and defend Striking Beauties, Studio and Landlord against all claims, liabilities, damages, liens and expenses(including without limitation, attorney’s fees whether or not a suit shall be brought) arising directly or indirectly from any use of the Studio by myself or any third party gaining access to the Studio by means of my access pass. I acknowledge that I have been informed that I shall not permit any third party to gain access to the Studio during the time of my use unless they too have a VIP Access Card and Membership ;that I am prohibited from allowing any third parties, including family, friends, minors or animals access to the Studio while I am using said facility; failure to abide by this policy is cause for immediate termination of my membership but that I will remain liable for the remainder of the membership contract.I am fully aware that neither a fitness expert nor any other authority or Studio personnel may not be present at said Studio during the hours which I chose to use the facility. I am further aware that there exist 24 hour video surveillance cameras inside the studio as well as in the parking lot of the Studio, as well as panic buttons inside the Studio. I acknowledge that I have been shown the location of all video cameras and panic buttons by the staff of the Studio and I have been instructed on how to activate said panic button in case of emergency. I understand that my VIP Membership and Access card is not a right but a privilege which may be terminated at any time and is not transferable to, nor to be used by, any other party

PLEASE NOTE THAT ONLY MEMBERS OVER THE AGE OF 16 YEARS MAY USE THE FACILITY WITHOUT PARENTAL SUPERVISION

Should any provision of this agreement and waiver be determined to be invalid or unenforceable, it shall be deemed severed from this agreement and waiver and such
invalidity, or enforceability shall not affect the remaining provisions of this agreement and waiver which shall remain in full force and effect.
